Our Terms and Conditions for Service

Zzari.net’s goal is to provide as unrestricted and satisfying an Internet experience as possible for our customers. These common rules are designed to satisfy what the law demands, to protect Zzari.net, and to protect our customers. These terms and conditions are similar to what you would find at any quality ISP, and are the general guidelines the Internet community tends to deem as good “netiquette.”


1. Dialup usage – Dynamic access

Unlimited intermittent dynamic access allows one user to dial up to Zzari.net’s Internet service as often as required. This service does not allow for a connection to be kept open for extended periods of time if not in use or to connect a server or other device as a dedicated connection. The account holder is ultimately responsible for the account. If someone is using your account, and you are not aware of it, you are still responsible for charges, etc.

2. Enforcement of terms and conditions

Depending upon the circumstances of any violation of our Terms and Conditions (including any actions that cause damage, downtime, excessive load, or harm to people or systems) we may issue a warning or suspend your service.

3. Disclaimer – Loss of data or business

Although Zzari.net takes great care to maintain and secure our servers, it is unavoidable that from time to time servers will temporarily fail. Zzari.net disclaims any and all responsibility for the loss of, or damage to, any customer data stored on our system, or for any consequential damages related to such loss, damage, or unavailability. Zzari.net’s services are provided with no warranty or merchantability or fitness for a particular purpose. In no event shall Zzari.net be liable for incidental, consequential or special damages including, without limitation, loss of data or profits, regardless of whether Zzari.net has been advised of the risk of such damages in advance. By using our services at any time, you unconditionally agree to indemnify and hold harmless Zzari.net from and against loss, suit, damage or claim including reasonable attorneys’ fees.

4. Backup of data

While Zzari.net performs regular, scheduled backups, the responsibility to protect and save your data rests with you. If you have something critical to your career, hobby, or business, it is your responsibility to keep a copy of it locally on your own computer. Our backups are designed for recovery from serious system failures, not for recovery of files accidentally or intentionally deleted by users.

5. Disclaimer – Content

Zzari.net and other Independent Networks may contain information or material which may be offensive and/or unsuitable for minors or adults. As Zzari.net does not control or monitor information accessible on Independent Networks, the customer agrees to discharge and hold harmless Zzari.net and its officers, trustees and employees from any and all claims, liabilities, demands, causes of action, costs, expenses or obligations of any kind, known or unknown, arising out of or in any way relating to his/her own or his/her child’s use of or access to Zzari.net or the Independent Networks.

6. Technical support

At Zzari.net, we must limit technical support to issues related to connectivity only. Our prime directive is helping you connect your computer through us to the Internet, and we will instruct you on how to get your email and load a browser. We cannot teach you how to design your web pages, how to write perl scripts, how to compile code, etc., except on a consultancy basis. At our discretion we may assist customers with non-connectivity issues. However, providing such additional service shall not be construed to mean that Zzari.net is obligated to provide such service.

7. Illegal activities

We may be required by law to report any criminal activity that we become aware of. If it comes to our attention that you are using our system to commit illegal acts (e.g., storing or transporting commercial software via our system illegally) we must immediately suspend your service. We support your right to free speech, but can’t support your use of our service to harm, abuse, harass, or libel others. By use of our service, you indemnify Zzari.net from any damages resulting from your actions or the content you store on our systems.

8. Spamming

Spamming is not tolerated at Zzari.net. Spamming is sending unsolicited email, whether “mass” or ostensibly targeted, to people who have not asked for such email. Spam is also posting to Usenet news a single cross-post to many newsgroups, or many individual posts to multiple newsgroups that are not related to the topic of your article, or where doing so is in violation of a group’s charter or common use. Spam sent via other networks, but referencing email addresses or websites at Zzari.net is similarly prohibited. You may not use Zzari.net as a “drop off” address for replies to spam mail or spam posts sent from other networks.

9. Denial of service attacks

You may not mount an attack against our system or any other. This includes mail bombing, “hacking” or attempting to gain root access, tsunami or flood bots or annoyance utilities like “nuke” or “flash,” employing packet sniffers, flood pings, etc.

10. Billing and cancellations

All startup fees and equipment sales must be paid for in advance, before equipment is shipped or circuits are activated. Much like having to pay for a rented movie that you don’t watch, you must pay for your Internet access ability even if you don’t log in and use it. Charges accrue from the time you sign up until you formally cancel with written notice via email or U.S. mail to Zzari.net. In order to avoid unnecessary charges, please provide notice of cancellation prior to the first of the following month. In the event of cancellation after the 1stof the month, no refunds shall be issued for the remainder of the month.

11. Domain name issues

All domains hosted by Zzari.net or using our DNS servers are kept at Zzari.net until the customer has paid all past debts to Zzari.net. We will not process any request to move any domain for any customer having a past-due amount owed to Zzari.net; and we reserve the right to wait for the check/payment to clear the bank before releasing the domain. Similarly, we cannot move domains to Zzari.net from other ISPs in cases where unpaid debts to the former ISP are a problem.

12. Local numbers

Make sure that Zzari.net’s dialup number is local to you! Zzari.net cannot and will not be held responsible for phone charges, whether due to a telephone company error or yours. Always check with your telephone company to ensure Zzari.net’ numbers are local to you.

13. Concurrent dialups

We allow only one simultaneous dial-in per account. This means that you may not use more than one of Zzari.net’s lines at the same time. If you are found logged in more than once over a modem connection, we will assume that your password has been compromised and will immediately suspend your account. There are some circumstances when we may permit multiple dial-ins for business accounts.

14. Agreements with minors

Zzari.net requires that its agreement be made with a person who is qualified to contract. As such, customers must be eighteen years or older. Otherwise, a parent or guardian must accept this agreement and assume responsibility for payment of Zzari.net’s services and for Customer’s compliance with this agreement.
